FTC’s report said industry middlemen inflate drug costs and squeeze independent pharmacies

Last Updated: First Published:

Cigna Group’s pharmacy benefit manager Express Scripts on Tuesday sued the U.S. Federal Trade Commission, alleging that the agency’s July report on the PBM industry was biased and defamatory and asking the court to order the FTC to withdraw the report.

The report is “seventy-four pages of unsupported innuendo leveled against Express Scripts and other PBMs,” Express Scripts alleged in its complaint, filed in federal court in the Eastern District of Missouri. The FTC “disregarded the millions of documents and terabytes of data” produced by PBMs, relying instead on “unverified comments” from companies that PBMs negotiate against when working to lower drug costs, the suit alleged.
